IMPORTANT ANNOUNCEMENT FOR MEMBERS
As you are aware, the City of Sydney Council refused our Section 96 Fit out Plan for a number of reasons. However, there appears to be an underlying concern by Council that the Club will trade with poker machines near a supermarket.
It is important to note here that there are no statutory requirements or restrictions that prevent a Licensed Club with poker machines from being located in and trading from the same building in which a supermarket is located.

Your Board, in the best interest of our members, decided to appeal that decision by the Council and take it to the Land & Environment Court. The Club was participating in good faith and was prepared to make many concessions to resolve the matter. However, no agreement was reached and the Conciliation Conference was terminated.
The Council does not have jurisdiction on whether a licensed venue can, or cannot, trade with poker machines in a club and cannot refuse an application on the grounds of poker machines. This is stipulated in the Gaming Machine Act 2001-Section 209.
With South Sydney Leagues Club members overwhelmingly voting at the AGM in August 2008 to have poker machines, we are acting on this directive by the members and investigating our options, together with our legal advisers, as to how we can provide our members with a club they want.
We will continue to keep our members informed on future progress. (for the full story click here) |
